Please read these Terms & Conditions (“Terms”) carefully. By accessing or using motorsalesacademy.co.za (the “Site”) and purchasing or accessing our courses, you agree to be bound by these Terms.
1) Acceptance of Terms
These Terms form a binding agreement between you and Motor Sales Academy (“MSA”, “we”, “us”, “our”). If you do not agree, do not use the Site or purchase any courses.
2) Eligibility & Accounts
- You must be at least 18 years old or have legal consent to enter binding agreements.
- You agree to provide accurate, complete information when creating your account and keep it updated.
- Accounts are personal and non-transferable. Do not share your login. We may suspend accounts for misuse.
- Access your dashboard at /my-account/.
3) Pricing, Payments & Taxes
- Prices are shown in South African Rand (ZAR) unless stated otherwise and may change without notice.
- Payments are processed securely via PayFast (cards, Instant EFT, supported wallets).
- By submitting a payment, you warrant that you are authorised to use the selected payment method.
- Where applicable, VAT and other taxes/fees may be included or added as required by law.
- Promotions or coupons are subject to separate terms and may be withdrawn at any time.
4) Course Access, Licensing & Sequencing
- Upon successful payment confirmation, course access is typically granted immediately to your account.
- You receive a limited, non-exclusive, non-transferable, revocable licence to access the purchased course(s) for your personal learning only.
- Courses may unlock sequentially (Module 1 → Module 2 → …). You must complete prerequisites where required.
- Content is provided online inside the Academy; downloads are not provided unless explicitly stated.
5) Intellectual Property & Usage Restrictions
- All content (videos, text, graphics, images, logos, quizzes, certificates) is owned by MSA or its licensors and protected by copyright and other laws.
- You may not copy, reproduce, distribute, publicly display, resell, “screen-record,” or create derivative works from our content.
- Sharing access, posting content publicly, or redistributing materials is strictly prohibited and may lead to account termination without refund and potential legal action.
6) Academic Integrity
- You agree to complete quizzes and assessments honestly. Use of unauthorised assistance during graded assessments is prohibited.
- We may use technical measures (timers, randomisation, attempt limits) to protect assessment integrity.
- Evidence of cheating, account sharing, or content misuse may result in suspension or termination without refund.
7) Assessments, Rewrites & Certificates
- Modules may include quizzes with defined pass marks and attempt rules as shown on the course page.
- Where offered, a first rewrite may be free; subsequent rewrites may require a fee (see course details).
- Certificates are issued digitally after meeting all requirements (including the final assessment in Part 3, if applicable).
8) 3-Vehicle Challenge (Practical)
- Eligibility requires successful completion of all prior modules and the final assessment.
- MSA will coordinate with partner dealerships for the supervised practical. Availability may vary by region and time.
- You must comply with all dealership policies, codes of conduct, and applicable laws during the challenge.
- MSA is not responsible for employment outcomes; the challenge validates practical readiness.
9) Refunds
- No refunds once a course is opened or accessed. Limited exceptions apply for duplicate payments, verified fraud, or unresolved technical failure.

10) Privacy & Cookies
- We process your personal data according to our Privacy Policy.
- We use cookies and similar technologies as described in our Cookies Policy.
11) Acceptable Use & Prohibited Conduct
- Do not attempt to bypass security, scrape content, or interfere with the Site’s operation.
- Do not upload or transmit unlawful, defamatory, or infringing content.
- Do not harass, abuse, or harm other learners or staff.
12) Availability, Support & Maintenance
- The Site and courses are provided on an “as-is” and “as-available” basis. We strive for high uptime but do not guarantee uninterrupted access.
- We may perform maintenance or updates that temporarily affect access.
- For help, contact admin@motorsalesacademy.co.za. Response time is typically 1–2 business days.
13) Disclaimers
- Training content is for educational purposes only and does not guarantee employment, income, or specific outcomes.
- We make no warranties (express or implied) regarding completeness, accuracy, or suitability for a particular purpose.
14) Limitation of Liability
To the maximum extent permitted by South African law, MSA will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Site or courses; (b) any conduct or content of any third party; or (c) unauthorised access, use, or alteration of your transmissions or content.
15) Indemnity
You agree to indemnify and hold harmless MSA, its directors, employees, and partners from any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in any way connected with your use of the Site, courses, or breach of these Terms.
16) Suspension & Termination
- We may suspend or terminate your access for violations of these Terms, suspected fraud, academic misconduct, or unlawful activity.
- Upon termination, your licence to access courses ends immediately. No refunds will be provided in such cases.
17) Changes to Terms
We may update these Terms from time to time. The “Last updated” date reflects the latest version. Continued use of the Site after changes constitutes acceptance of the revised Terms.
18) Governing Law & Dispute Resolution
- These Terms are governed by the laws of the Republic of South Africa.
- Disputes should first be raised with our support team. If unresolved, the parties will consider good-faith negotiation and, if needed, mediation before formal proceedings.
19) Miscellaneous
- Severability: If any provision is found invalid, the remaining provisions remain in effect.
- No Waiver: Our failure to enforce a right is not a waiver of that right.
- Assignment: You may not assign your rights under these Terms without our prior written consent.
- Entire Agreement: These Terms, together with our Privacy Policy, Refund Policy , and Cookies Policy, constitute the entire agreement regarding your use of the Site and courses.
20) Checkout Consent
At checkout, you will be asked to confirm: “I have read and agree to the Terms & Conditions and Refund Policy.” By proceeding with payment, you acknowledge and accept these Terms.
